1. ScopeThese Terms of Service govern the legal relationship between xtendx AG ("xtendx") and its customers ("Customer") regarding the use of hosting, streaming and application service providing services.
2. Contract FormationA contract is concluded when the customer accepts an offer in writing or electronically, or by using the services provided by xtendx.
Contractual components may include:- offers or order confirmations- service descriptions- service level agreements- usage policies
3. Servicesxtendx provides infrastructure, platform software and hosting services enabling customers to operate video, streaming or web solutions.
xtendx may involve third-party providers to deliver the services.
4. Customer ResponsibilitiesThe customer is responsible for all content processed or published through the platform, including:
- documents- images- audio and video files- software- databases- links to external content
The customer agrees to use the services in compliance with applicable laws and xtendx usage policies.
5. MisuseIn case of illegal activity or violation of usage policies, xtendx may remove content, restrict services or terminate the contract without notice.
6. Maintenance and SupportSupport is generally provided during business hours.

Additional service levels may be agreed in a Service Level Agreement.
7. Pricing and PaymentInvoices are issued according to the agreed contract terms.
Invoices must be paid within the specified payment period.
xtendx may suspend services in case of overdue payments.
8. Liabilityxtendx provides services with professional care.
However, uninterrupted availability of internet-based services cannot be guaranteed.
xtendx is not liable for damages resulting from:- internet outages- cyber attacks- data loss outside the control of xtendx.
9. Confidentiality and Data ProtectionBoth parties agree to keep confidential information strictly confidential.
Personal data is processed in accordance with the xtendx privacy policy.
10. Intellectual PropertyAll rights related to the platform, software and infrastructure remain with xtendx or its licensors.
Customers receive a non-transferable right to use the services during the contract term.
11. Force Majeurextendx is not liable for service interruptions caused by events beyond its control, including natural disasters, war, strikes or infrastructure failures.
12. Term and TerminationContract duration is defined in the respective offer or agreement.
Contracts may automatically renew unless terminated within the agreed notice period.
After termination, xtendx may delete customer data.
Customers remain responsible for their own data backups.
13. Changesxtendx may update these Terms of Service at any time. The current version will be published on the website.
14. Governing Law and JurisdictionSwiss law applies.
Place of jurisdiction is Zurich, Switzerland.
